Maharashtra: Bombay High Court Asks State Government to Implement Policy for EV Charging Stations in Housing Societies ( Representational Image )
The High Court recently observed that providing e-charging stations for electric vehicles within housing societies would help reduce air pollution. The court has directed the state government to finalize and implement the policy for setting up charging points/stations in housing societies at the earliest.
Despite repeated requests and appeals, several housing societies have denied permission to install charging stations within their premises. Consequently, a businessman from Peddar Road filed a petition in the High Court. Responding to this, the bench comprising Justice Girish Kulkarni and Justice Advait Sethna issued the above order. The court noted that the issues raised in the petition are not just important from the perspective of technological advancement in the automobile sector but also highlight the positive environmental impact of e-vehicles in reducing pollution.
The bench emphasized the current need for charging stations in housing societies, stating that it would significantly contribute to lowering air pollution levels. The relevant state departments have already drafted guidelines, which include provisions for individuals seeking permission to set up charging points within society premises. Municipal authorities and related department officials are aware of the increasing demand for such stations, which is expected to grow further in the future, the court added.
‘Finalize Draft Rules as per Law’
While the court cannot interfere with policy decisions, it emphasized that a clean and pollution-free environment is an integral part of the fundamental rights under the Indian Constitution. Therefore, it is essential to finalize the draft rules related to proper management within housing societies in accordance with the Maharashtra Cooperative Societies (MCS) Act.
