Thane man arrested for using Triple Talaq to divorce Wife over solo walk
Authorities in Thane district, Maharashtra, have registered a case against a 31-year-old individual for reportedly practicing ‘triple talaq’ (instant divorce), a practice that was prohibited in 2019, according to an official statement released on Friday.
The individual facing charges, who resides in the Mumbra region, contacted the father of his 25-year-old spouse on Tuesday to inform him that he was terminating their marriage using ‘triple talaq’, which is now considered a criminal act. This decision was reportedly made because she had gone for a walk by herself, according to the official.
On Wednesday, following a complaint lodged by his wife, law enforcement authorities filed a First Information Report (FIR) against the individual under section 351(4) of the Bharatiya Nyaya Sanhita for the offense of criminal intimidation, as well as under the Muslim Women (Protection of Rights on Marriage) Act.
Triple talaq (instant divorce) and talaq-e-mughallazah (irrevocable divorce) are now prohibited methods of Islamic divorce that were once accessible to Muslims in India, particularly those following the Hanafi Sunni schools of thought.
A Muslim man had the legal right to divorce his wife by stating the word talaq (which means “divorce” in Arabic) three times in a row, whether verbally, in writing, or, more recently, through electronic means.
The Muslim Women (Protection of Rights on Marriage) Act, 2019 is a legislative measure enacted by the Parliament of India that makes triple talaq a criminal offense. In August 2017, the Supreme Court of India ruled that triple talaq, a practice allowing Muslim men to divorce their wives instantaneously, is unconstitutional.
