Flat owners who delay or refuse to pay housing society maintenance may now face stricter recovery action, even if the dues are many years old.

In an important verdict, the Bombay High Court has ruled that society maintenance is not an optional payment but a continuous legal duty, giving cooperative housing societies stronger powers to recover arrears.

What Was the Dispute?

The case involved flat owners who had been occupying four flats since 2005 but had not completed formal society membership or registered agreements.

When the society demanded unpaid maintenance arrears in 2023, the owners approached the court, claiming the dues were too old and therefore “time-barred”.

Court’s Key Message: No Escape Through Limitation Claims

The High Court rejected the argument and clarified that under Section 154B of the Maharashtra Cooperative Societies Act, there is no fixed time limit for recovery of maintenance dues.

This means societies can legally pursue unpaid amounts even if they date back many years.

Maintenance Is a Monthly Responsibility

The court described maintenance payment as a continuing obligation, since it is due every month.

Non-payment is treated as a continuing wrong, meaning the society’s right to recover does not expire until the arrears are cleared.

Even Non-Members Must Pay

A major highlight of the ruling is that flat owners cannot avoid maintenance by saying:

“I am not a society member.”

The court noted that anyone using building facilities such as lifts, water, security and common services must contribute towards maintenance.

Arrears Are Linked to the Flat

The High Court also observed that maintenance dues are connected to the flat/property, not just the individual owner. Whoever benefits from the flat remains responsible for payment.

Recovery Can Be Done Like Land Revenue

The ruling strengthens societies by allowing recovery of arrears through a process similar to land revenue arrears, once the Registrar issues a recovery certificate.

Why This Verdict Matters

This decision is expected to bring relief to cooperative housing societies and ensure fairness for residents who pay regularly, while discouraging long-term defaulters.
