New regulations to enhance the security and regulation of telecommunications services, ensuring better compliance and protection for consumers
The Indian government has implemented the New Telecommunication Act to regulate mobile and internet usage. Here are the key rules and associated penalties for non-compliance:
Key Rules
1. SIM Card Limitations
Maximum of 9 SIMs per person.
For residents of Jammu and Kashmir or the North Eastern region, the limit is 6 SIMs.
2. Biometric Verification
Mandatory biometric verification for purchasing a SIM card.
No SIM card purchase or use with another person’s documents.
3. Government Installation of Mobile Towers
The government can erect mobile towers on private property without the owner’s consent if necessary.
4. Emergency and National Security Measures
The government can shut down telecommunications in any area during emergencies or national security concerns.
The government can monitor messages; journalists are generally exempt but can be monitored if there are doubts.
5. Consent for Commercial Messages
Companies must obtain permission before sending commercial messages to users.
6. Digital India Fund
A fund collected from telecommunication companies will be used to enhance mobile network facilities in rural areas, potentially leading to increased SIM charges.
7. Restriction on Network Suspension
Private companies cannot suspend or stop mobile network services without government permission.
8. Complaint Department
A dedicated department has been established to resolve disputes between consumers and telecommunication companies.
9. Mobile Number Portability
A 7-day waiting period is required for switching a mobile number to a new network.
Penalties for Violations
1. Exceeding SIM Limits
Fine of ₹50,000 for the first offence.
₹2 lakh fine for subsequent violations.
2. Fraudulent SIM Acquisition
Up to three years of imprisonment, a fine of up to ₹50 lakh, or both for using someone else’s identity documents to obtain a SIM card.
3. Unauthorized Commercial Messages
Fine of up to ₹2 lakh and potential discontinuation of the company’s service for sending commercial messages without consent.
4. Unauthorized Service Interruption
Three years of imprisonment, a fine of ₹50 lakh, or both for interrupting telecommunications services without government permission.
5. National Security Violations
Up to three years of imprisonment, a fine of up to ₹2 crore, or both for violating laws related to national security.
