A complaint has been lodged against e-commerce giants Flipkart and BigBasket for reportedly requiring delivery personnel to work on April 19, the day of voting in the state. Chennai High Court lawyer K Narasimhan filed the complaint before Tamil Nadu’s state election commissioner, B Kothi Nirmalasamy, asserting that despite the government’s declaration of April 19 as a public holiday for the election, Flipkart and BigBasket are assuring guaranteed delivery services on that day.

Mr. Narasimhan highlighted that April 19 has been officially declared a public holiday under Section 25 of the Negotiable Instruments Act, 1881, to facilitate the electoral process. The Labour Welfare and Skill Development Department of Tamil Nadu has also mandated a paid holiday for employees in various sectors to ensure their participation in the democratic process.

Expressing serious concerns about the infringement of delivery personnel’s rights, particularly those integral to the operations of these platforms, the complaint demands an investigation into the claims of e-commerce companies guaranteeing delivery on voting day. It urges appropriate measures to uphold the democratic rights of all workers, irrespective of their employment status.

In response, Flipkart clarified that it is providing paid holidays to eligible employees and adhering to directives and guidelines provided by the authorities regarding polling day. The company emphasized its commitment to driving awareness and encouraging employees to exercise their right to vote.

The complaint underscores the importance of respecting poll day offs for workers, ensuring their active participation in the democratic process without compromising their rights or obligations.
