The Supreme Court on Tuesday came down heavily on a woman demanding extravagant alimony following a brief 18-month marriage, stating that highly qualified individuals should support themselves financially rather than depend on their spouses.
The woman, reportedly an IT professional with an MBA degree, sought a luxury flat in Mumbai’s Kalpataru complex, ₹12 crore in maintenance, and a BMW car from her estranged husband. The Chief Justice of India (CJI) B.R. Gavai questioned the legitimacy of such demands, stressing her ability to earn.
“You’re an IT person. You’ve done your MBA. You’re in demand in places like Bengaluru and Hyderabad. Why don’t you work?” the CJI asked, as quoted by NDTV. “You had a marriage of just 18 months. And you want a BMW too?” he added.
The woman claimed her husband, a wealthy individual, had filed for annulment on the grounds of her alleged schizophrenia. “Either you get a flat free of all encumbrances or nothing,” the CJI said, as reported by Bar and Bench. “When you are highly educated and choose not to work out of your own volition…”
This isn’t the first time the judiciary has emphasized self-sufficiency. In March 2025, the Delhi High Court ruled that interim maintenance should not encourage idleness. Interpreting Section 125 of the CrPC, the court stated that a well-educated woman with work experience should not avoid employment merely to claim financial support.
Similarly, in a December 2024 ruling, the Supreme Court noted that alimony is not a tool to equalize financial status post-divorce. “It cannot be expected of the husband to maintain [his wife] as per his present status all his life,” the bench had said, underlining that spousal progress post-separation should not become a liability.
