MahaRERA Slams Pune Builder for Delay, Orders Compensation and Timely Flat Handover
Pune, July 8, 2025– In a significant relief for homebuyers, the Maharashtra Real Estate Regulatory Authority (MahaRERA) has pulled up a Pune-based builder for delaying the handover of a flat and ordered him to compensate the buyer for the delay. The builder has been directed to pay monthly interest to the homebuyer at the State Bank of India’s Marginal Cost Lending Rate (MCLR) plus two percent and hand over possession with an Occupancy Certificate (OC) within one month.
The ruling comes after a complaint filed by Atul and Sangeeta Lokhande against PM Construction, which failed to deliver possession of a flat in Thergaon as promised in the agreement. The Lokhandes had paid ₹46.59 lakh (excluding stamp duty and taxes) for the property and were assured possession by December 31, 2019. However, the flat was handed over much later on July 18, 2024, without the required Occupancy Certificate and with incomplete amenities like lifts, gardens, and water supply.
Despite receiving a notice from MahaRERA, the builder failed to appear before the authority. Consequently, MahaRERA passed an ex-parte order in favor of the buyers.
As per Section 18 of the RERA Act, if a promoter fails to deliver a flat on time, the buyer is entitled to claim compensation or interest for the delay. MahaRERA held that the builder’s actions violated this provision and directed strict compliance with its order.
