Justice Surya Kant, who took oath as the 53rd Chief Justice of India on Monday, is back in the spotlight for a series of landmark observations, rulings and speeches that shaped national debates.

Justice Surya Kant was sworn in as the new Chief Justice of India after President Droupadi Murmu administered the oath at Rashtrapati Bhavan. He succeeds Justice B R Gavai, who served a little over six months. As a Supreme Court judge, Justice Kant presided over matters ranging from constitutional law and electoral integrity to social justice and governance, delivering observations that drew widespread attention.

Here are some of his most discussed judicial comments and public statements:

1. On Talaq-e-Hasan And Women’s Dignity

While hearing a challenge to Talaq-e-Hasan, Justice Kant asked sharply:
“Is this how the dignity of a woman is upheld? Should a civilised society allow this?”
His remarks indicated that the issue may be referred to a Constitution bench.

At an event in San Francisco, he cautioned against judicial overreach, saying:
“Courts must not supplant the legislature… They must act as facilitators of democratic dialogue.”

3. On Digital Fraud And ‘Digital Arrest’ Scams

In November, he took a strict view on the rising “digital arrest” fraud cases, observing:
“The extent of fraud is huge — ₹3,000 crore was collected from victims in India alone.”
He promised to deal with the matter with an “iron hand.”

4. Defence Of The Collegium System

Speaking at Seattle University, he highlighted the need to protect judicial independence:
“The Collegium system significantly limits interference by the Executive and Legislature.”

5. On Dignity Under Article 21

During a hearing related to comedian Samay Raina, he observed:
“Article 21 must prevail if any competition takes place with Article 19.”

6. On Reservation Politics

In a case concerning OBC reservation in Maharashtra’s local body polls, he remarked:
“In this country, the reservation business has become like a railway… Those who have entered the bogie don’t want anyone else to enter.”

7. On Delay In Pronouncing Judgments

Justice Kant criticised pending reserved judgments, stating:
“People need judgments, not jurisprudence. Give a reasoned order — allow or deny relief.”

8. On Climate Change And Global Responsibility

In July 2024, he said developing countries like India are often blamed disproportionately, noting:
“Wrongdoers often fly under the radar.”

9. On Technology And Access To Justice

In August, he emphasised the transformative potential of tech-enabled justice:
“Technology can democratise legal awareness and bring legal aid to the palm of every citizen.”

10. On Judiciary’s Role In Strengthening Democracy

At the Sri Lankan Supreme Court, he said:
“Courts deepen democracy when they act to empower the powerless, grounded in constitutional text and moral clarity.”

Justice Surya Kant’s career has been marked by a blend of bold courtroom interventions, strong positions on constitutional values, and repeated calls for judicial efficiency. His leadership as the 53rd CJI is expected to shape critical areas including electoral reform, digital fraud, judicial transparency, and access to justice.
