Orders issued to PMC, PCMC and Ministry of Defence by High Court to check illegal constructions around ammunition factory in KhadkiÂ
On Wednesday, 3rd April 2024, the High Court issued an order directing the Pune and Pimpri-Chinchwad Municipal Corporations and the Ministry of Defense to conduct a survey of illegal constructions within the restricted area of the ammunition factory in Khadki. This decision stemmed from a Public Interest Litigation (PIL) filed by two Pune residents, highlighting concerns about residential buildings within the restricted zone.
The bench, led by Chief Justice Devendra Kumar Upadhyay and Justice Arif Doctor, emphasized that the issue extends beyond illegal constructions, touching on encroachments on Defense Ministry premises.
Moreover, It urged for prompt completion of the survey, noting the pending matter in the Supreme Court. The court stressed the importance of proactive measures to address encroachments on lands owned by the Preservation Department.
During previous hearings, the court expressed dissatisfaction with the Ministry of Defense’s responses and reprimanded the state government for permitting construction in the area. It emphasized the dangers of irregular urban planning and the risk posed to human life by constructing buildings in restricted zones.
In response, a meeting was convened involving the Ministry of Defence, State Government, Commissioner of Pune and Pimpri Chinchwad Municipal Corporations, and Pune Collector, aiming to devise a feasible solution.
The court warned of strict action should the defendants fail to address the issue adequately.
The PIL specifically demands an order prohibiting further construction within the restricted area. To address these concerns, the court ordered a survey of illegal constructions in the Darugola area.
