Rahul Gandhi disqualified as Lok Sabha MP

Rahul Gandhi has been disqualified as a member of the Lok Sabha from the date of his conviction in the criminal defamation case on March 23 over his ‘Modi surname’ remark. 

Congress leader Rahul Gandhi has been disqualified as a member of the Lok Sabha from the date of his conviction. The decision came in after the Surat court gave its verdict in the criminal defamation case over his remarks made on ‘Modi surname’. A notice issued by the Lok Sabha Secretariat said he stood disqualified from the House from March 23.

The notice from the parliament stated, “Rahul Gandhi… stands disqualified from the member of Lok Sabha from the date of his conviction,”. 

A complaint against Rahul Gandhi was filed by BJP MLA Purnesh Modi over the remarks made by Gandhi on surname Modi. 

The Indian National Congress has stated this judgment as a politically motivated action by the Bharatiya Janata Party (BJP).

H H Varma, chief judicial magistrate, held Gandhi guilty under Indian Penal Code (IPC) sections 499 and 500, and also granted him bail and suspended the sentence for 30 days to allow him to appeal in a higher court.

Rahul Gandhi can escape his disqualification if the appellate court suspends his conviction and also the two year jail term.
