In cities like Mumbai, where a large number of people live in rented homes, it is essential to understand that renting is not just an informal agreement between two people. It involves legal rights, duties and protections. Various laws are in place to prevent unfair eviction, arbitrary rent hikes and invasion of privacy. The Central Government’s Model Tenancy Act, 2021 (MTA) has further strengthened tenant rights, though its implementation depends on individual states.

Protection Against Unfair Eviction
A landlord cannot evict a tenant without a valid legal reason. Common grounds include unpaid rent for over two months, misuse of property, or violation of the rental agreement. Even after the tenancy period ends, the landlord cannot forcibly remove a tenant without a court order or approval from the tenancy authority.

Notice Period Requirement
Before eviction, a formal notice must be given to the tenant. The notice period is usually mentioned in the rental agreement.

Security Deposit and Rent Hike Rules under the Model Tenancy Act, 2021
For residential properties, the security deposit cannot exceed two months’ rent; for commercial properties, it cannot exceed six months’ rent. After the tenant vacates the house, the landlord must return the security deposit after deducting only valid repair costs.
Rent increases must also follow the terms of the agreement. Under the MTA, landlords must give a written notice of three months before increasing rent. Arbitrary or sudden hikes are not allowed.

Right to Privacy and Essential Services
Tenants have the right to peaceful living. Landlords cannot enter the rented home without prior permission or at least 24 hours’ notice, except during emergencies. Entry is allowed only between 7 a.m. and 8 p.m.
Basic services like water, electricity and sanitation cannot be disconnected by the landlord, even if there is a dispute.

Right to Repair and Maintenance
Landlords are responsible for major repairs. If they refuse or delay necessary repairs, the tenant may carry them out and adjust the cost from the rent, in accordance with state laws or agreement terms.

Importance of a Written Rental Agreement
A written and registered rental agreement protects both tenant and landlord. It helps prevent disputes and serves as legal proof of agreed terms. Since each state may have different tenancy rules, tenants should stay informed about the laws that apply where they live.
