A family court has ordered a man, accused of physically, mentally, and financially abusing his wife, to pay ₹20,000 per month as interim maintenance and ₹10,000 per month as house rent. The payments are to continue from the date of filing the application until a final decision is made.

Case Background

Rakesh and Smita (names changed for privacy) met through a matrimonial site and were married on November 25, 2022. Shortly after their wedding, Rakesh left for London for business purposes. Despite Smita’s expectations of a warm welcome from her in-laws and being reunited with her husband, she was abandoned.

Rakesh, who holds ILR (Indefinite Leave to Remain) in London, had the ability to bring Smita with him but only arranged for an ordinary visa, which was subsequently rejected. Requests from Smita to secure a spousal visa and live with her husband were ignored.

Forced to return to her parental home, Smita filed a complaint citing domestic violence and disrespect towards her and her parents.

Court Observations

The court noted that Smita’s testimony and evidence established prima facie domestic violence. The husband, Rakesh, failed to disclose his assets and liabilities, suggesting attempts to hide his income. However, documents presented by Smita revealed his financial capacity, including the purchase of a four-wheeler in 2022 and earnings of £2,609 per month, amounting to £18,531 YTD in 2023.

Verdict

The court ruled that Rakesh has the financial means to support Smita and ordered him to provide interim alimony and house rent. This ruling ensures financial relief for Smita as the case proceeds.
