The anticipatory bail petitions filed by a businessman cum developer and his manager were dismissed by Additional Sessions Judge S.R. Narwade. They were accused of obtaining fake documents to sell a plot to a customer.

The allegations surfaced following a complaint lodged against renowned builder Rahul Rasiklal Nahar at the Hinjawadi police station by Sabir Nazeer Ahmed Shaikh, a resident of Koregaon Park. The complaint pertained to the sale of a plot in Mugavade, Mulshi taluka, through fraudulent means, spanning from 2010 to March 10, 2024.

Per police reports, Nahar, his manager Sai Kerkar, and another unidentified individual were implicated in the case. Shaikh, the complainant, expressed interest in the plot after seeing an advertisement in a newspaper about the Olympia plot scheme in Mugawade village. He was informed about the scheme by Nahar’s company’s marketing and sales team. Subsequently, Shaikh met Nahar, who assured him of the scheme’s legitimacy. Trusting the sales team and Nahar, Shaikh decided to purchase a plot measuring 7,635 square feet. On July 30, 2010, an ‘agreement to sale’ was signed by Nahar, the owner of Exerbia Developers, and advocate Yogesh Narayan Nikam. Shaikh paid Rs.26.52 lakh in cash and cheques to Nahar. However, Nahar failed to provide the purchase deed, citing company protocol.

Shaikh, who was abroad from 2011 to 2017, upon his return, requested Nahar to finalize the purchase deed as per the agreement. Despite repeated requests, Nahar refused. Suspecting foul play, Shaikh visited the sub-registrar’s office in Mulshi in 2021 and discovered that the plot documents were forged, leading to the registration of a case.

In their plea for anticipatory bail, Nahar and his manager argued their innocence. However, both the prosecution, represented by additional public prosecutor Sanjay Pawar, and Shaikh’s lawyer, Anup Kumar, opposed the bail applications, emphasizing the necessity for police custody to investigate the procurement of fake documents.
