Pune Family Court Rejects Earning Wife’s Interim Alimony Plea
A Pune family court has recently rejected a 46-year-old woman’s application for interim alimony, citing her steady income as a teacher and the fact that both children are adults. The court also highlighted that the father was paying the education expenses of the younger son.
The woman, who earns Rs. 7,000 per month as a teacher and an additional Rs. 60-65,000 from private tuition, had requested Rs. 25,000 per month as interim alimony. Her husband’s lawyer argued that his income was less than hers, and since the children are adults and the elder son is working, there was no need for maintenance.
The couple, married for over 25 years, has two children aged 25 and 17. The wife filed a divorce suit under the Domestic Violence Act and the Hindu Marriage Act, alleging physical, mental, and financial hardship from her husband.
Judge S. N. Rukme rejected the wife’s application, considering factors such as income, employment status, and financial independence. This decision underscores the importance of individual circumstances in maintenance claims.
