Pune, December 4, 2025: Aurangabad Bench of Bombay High Court upholds truth, rejects baseless IPC 376/377 charges against husband and relatives. SIFF applauds the verdict as a milestone in protecting innocent men from legal misuse.

celebrates a significant victory in the fight against harassment and false accusations.

With SIFF’s guidance and unwavering support, “Anand Doiphode”, resident of Pune overcame legal adversity, highlighting that justice and truth prevail with resilience and determination.

A Marriage That Turned Into Trauma:

Anand married in October 2020 with love and hope. Within weeks, his wife began leaving for her parents’ home, returning only to fight and create scenes. This toxic cycle continued monthly, eroding peace and dignity. On 4th March 2021, Anand attempted suicide due to emotional

pressure. The next day, his wife left, later giving birth but denying him access to his son.

Legal System as a Tool of Vengeance:

In 2022, Anand filed for divorce after being alienated from his child. His wife retaliated with false charges—498A, dowry, IPC 377, and even IPC 376. Eight family members, including elderly women, were named in the FIR. Anand went into hiding for four months, fearing arrest and job loss. His family faced humiliation, stress, and social isolation from once-close relatives.

Broken Trust in Justice and Law Enforcement: 

Despite High Court orders, Anand was made to visit the police station for 11 days. His wife refused medical tests, while his mother and aunt were insulted during bail. The emotional toll shattered their dignity and trust in the system. Anand was questioning how a husband can be criminalized for intimacy in marriage. In search of answer for his question, he came across SIFF via internet where he read article of ‘Protest against Marital Rape Law’.

Legal Battle and Victory:

1. Overturning Section 377/376 IPC Allegation: With guidance from SIFF, Anand proved that IPC 377 and IPC 376 doesn’t apply between spouses and relatives which are at distinct places in matrimonial disputes. Armed with key judgments from Jabalpur and Allahabad High Courts, he filed a strong reply against Appeal from wife side in Bombay High Court, Aurangabad Bench. Within 12 months, the appeal is dismissed, marking a crucial victory and a huge relief for him and his family.

Turning Adversity into Strength with SIFF’s Support:

Anand discovered the Save Indian Family Foundation (SIFF), an NGO advocating for men harassed by false matrimonial cases. With their legal guidance and training, he gained the knowledge to challenge the charges effectively. SIFF Pune’s unwavering support helped him recover mentally, despite the immense psychological and financial toll he faced. Their encouragement strengthened his determination to fight back and persevere through the legal battles. This marked a turning point in Anand’s journey, empowering him to reclaim control over his life.

Time to Reform Rape Laws to Prevent Misuse:

The recent case involving a 22-year-old IT professional in Pune, who filed a fabricated rape complaint against a man ( saying Delivery Boy) she falsely accused of assaulting her in her apartment, is a chilling reminder of how easily stringent laws can be weaponized. The Pune Police, after thorough investigation, found the allegations to be baseless and registered a non-cognisable offence against the complainant. This case exposes a systemic vulnerability: the absence of safeguards against false accusations in our criminal justice system.

Anil Murty, Co-founder of SIFF said, “If government do not stop misuse of laws, we want one million false rape cases per year in India. Then Police and Judiciary will be busy in false cases and will not work on actual rape cases.”

Sameer Goel, National Co-ordinator at SIFF said “It is imperative that the judiciary now acts with an iron hand against the rampant misuse of marital rape, Section 377, rape, dowry and cruelty laws. If the judiciary continues to look away, it becomes a silent collaborator. Courts must now impose heaviest punishments for fabricated allegations, prosecute perjury without hesitation, and dismantle this organised abuse of the justice system. Today, one false allegation can annihilate a man’s life and drag even uninvolved relatives into criminal prosecution. This is not protection — it is legal terrorism. Innocent families can’t be sacrificed anymore.”

A biased law is a silent war:

Sagar Gunthal, Legal Counsellor at SIFF, highlights the misuse of laws, saying, “Laws targeting one gender are not laws, but weapons.” He notes that the misuse of non-bailable sections like IPC 377 and 376 in matrimonial disputes can lead to prolonged jail for husbands, resulting in severe consequences, including social stigma, emotional trauma, career damage, and family breakdown, underscoring the importance of fair and impartial justice.
