In response to complaints of alleged harassment and extortion by transgender persons in Pune, the Pune Police issued a prohibitory order under CRPC Section 144. This order, effective for a month starting April 12, restricts transgender individuals from moving around the city and visiting places for ceremonies and rituals without being invited. Additionally, they are prohibited from gathering at traffic junctions and soliciting money from passersby. Complaints highlighted that these visits often involved forceful demands for money and intimidating behavior. Such actions have led to reluctance among people to lodge complaints due to fear.
Section 144 of the Code of Criminal Procedure empowers district magistrates and officials with magisterial powers to issue such prohibitory orders in cases of possible nuisance or danger to law and order.
Violation of this order could lead to criminal culpability under various sections of the Indian Penal Code and the Maharashtra Police Act. The order remains in force until May 11, unless withdrawn earlier by the issuing authority. Objections to the order can be submitted, and they will be duly considered.
The move aims to prevent instances of nuisance and potential danger to the public. By restricting unauthorized visits and solicitation, the police intend to safeguard the community from harassment and extortion.
