Civil court holds PMC responsible for accidental death of youth

This is the first time the court has asked the Pune Municipal corporation to pay compensation to the deceased’s family

Pune: The civil court held the Pune Municipal Corporation (PMC) responsible for the death of a 20-year-old youth after he met with an accident, six years ago. The corporation has been asked to pay a compensation of ₹16.35 lakh with 16% interest for the years gone by, to his family members.  The order was passed by the senior civil judge S S Shinde.

The accident took place on June 26, 2016. The deceased youth and his friend were on their way to Kamgar Putla Chowk from Sancheti Hospital when his bike slipped due to a large pothole near the grade separator in front of the court entrance. In the accident, Yash died on the spot as a partially cut rod of an iron divider entered his chest. Therefore, the PMC has been held responsible for his death.   

The order stated, “It is the responsibility of the Municipal Corporation to keep the size of the divider right and maintain it. However, the accident happened because the officers and employees of the municipal corporation did not perform their responsibilities properly.”

The youth who died in the accident was identified as Yash Soni. His father had filed a court case against Pune Municipal Corporation in Civil Court for compensation. 

Advocate Ajit Kulkarni arguing the case against the PMC said, “It is the legal responsibility of the Municipal Corporation to keep the city roads free of potholes and also the dividers in proper condition. For the first time, the civil court has ordered the corporation to pay compensation in the instance of accidental death caused due to irresponsibility.”
