The Delhi High Court has reversed its previous order granting permission to a widow to terminate her 29-week pregnancy, emphasizing the right to life of the unborn child. 

The 26-year-old woman, now in her 32nd week of gestation, is encouraged to undergo delivery at either AIIMS or any Central or State hospital. 

The woman said she decided not to continue the ongoing pregnancy in December last year and approached the doctors for medical termination of her pregnancy. Since her gestation period was over 24 weeks, she was not allowed to medically terminate her pregnancy, prompting her to approach the court.

The woman, in her plea, said she got married in February 2023 and her husband passed away on October 19, 2023. The woman came back to her parents’ house and when she went for an ultrasound on October 31, 2023 it was found that she is 20 weeks pregnant

The court rejects the plea for foeticide, suggesting adoption if the petitioner is inclined. The Centre assures support, covering all medical costs and incidental charges. 

The decision underscores the importance of protecting the unborn child’s fair chance of survival.
