Govt Imposes Immediate Import Restrictions on Laptops, Tablets

In a recent development, the central government has taken swift action to restrict the import of laptops, tablets, and personal computers falling under HSN code 8471. The Directorate General of Foreign Trade conveyed this decision through an official notice, effective immediately.

Under this restriction, the import of these devices, including All-in-one Personal Computers and Ultra Small Form Factor Computers and Servers, will be categorized as ‘Restricted.’ Imports of these items will be permitted solely against a valid License for Restricted Imports.

However, it’s important to note that this restriction will not apply to imports made under Baggage Rules, subject to amendments as and when they occur, as clarified by the Ministry of Commerce and Industry.

The ministry also specified an exemption from Import Licensing requirements for specific scenarios. Individuals will not need an import license for up to 20 such items per consignment, provided they are intended for purposes such as Research and Development (R&D), Testing Benchmarking and evaluation, repair and re-export, and product development.

The government further clarified that the exemption extends to the import of 1 Laptop, Tablet, All-in-one Personal Computer, or Ultra Small Form Factor Computer, including those procured from e-commerce platforms via post or courier.

However, the exemption comes with conditions. Imported goods should be used exclusively for the stated purposes and are not to be sold. After fulfilling their intended purpose, these products must either be rendered unusable and destroyed or re-exported.

On the other hand, when these items are an integral part of a Capital Good, they will be exempted from import licensing requirements.

It’s worth noting that while a License for Restricted Imports won’t be necessary for the repair and return of the mentioned items, all imports will be subject to applicable duties as determined by the government.

The central government’s move underscores its commitment to regulating imports in specific categories, while also facilitating certain exemptions to encourage research, development, and innovation within the country.
