Pune: Builder Booked for Delayed Possession, Unfulfilled Promises in Kondhwa
Pune police have registered an FIR against Aliasgar Ismail Icecreamwala, the proprietor of M/s Royal Builders, for delaying the possession of a flat and failing to provide promised amenities in a housing project in Kondhwa.
The complaint was filed by Nilofar Yusuf Sayeed (60), a widow, at Kondhwa police station. She stated that her late husband had booked a flat in the Royal Sublines project in 2019 for ₹47 lakh, with possession promised in early 2023. However, after his passing in 2021 due to the pandemic, the builder failed to fulfill the commitment.
“The possession was repeatedly delayed despite multiple complaints. When no action was taken, I had no choice but to approach the court,” Nilofar told Pune Times Mirror.
Her legal counsel, Advocate Tosif Shaikh, filed a private complaint before Judicial Magistrate (First Class) AA Kulkarni in the Cantonment court. On March 7, the court directed Kondhwa police to investigate under the Bharatiya Nagarik Suraksha Sanhita, 2023. Following this, an FIR was registered on March 22.
A police official confirmed that an investigation is underway and the builder may be arrested soon.
Advocate Shaikh stressed that this case highlights the importance of holding builders accountable, as delays and unfulfilled promises cause significant distress to homebuyers.
