A disturbing & shocking incident took place inside the gym of Elina Living, a housing society on NIBM road in Mohammadwadi where, a routine gym visit turned into a brutal assault on Tuesday.

As per further information from the FIR accessed by Pune Pulse, Sandip Agarwal, accompanied by his wife & complainant Shweta Agarwal, was attacked by four individuals, allegedly with fists and an iron rod, following a dispute over members’ access to the facility.

Sandeep Agarwal narrates the horrifying incident ā€œMe & my wife Shweta went into the gym of our society. 4 people were working out there. Suddenly, they started yelling at us that the gym access is not for A & B wing members. When my wife entered the gym, they went aggressively towards her & started abusing her. I intervened & confronted the 4 people. However, they verbally abused me before launching a physical assault. The attackers mercilessly punched and beat me, even resorting to using an iron gym rod. Shweta pleaded with them to stop, emphasizing their shared education and societal standing. Despite her pleas, the violence continued. I have suffered brutal injuries on my eye on nose.ā€

Describing the background of the conflict, Shweta highlighted issues related to maintenance and the use of common amenities in the society. The altercation unfolded when Sandip and Shweta attempted to use the gym, and the accused, residing in A and B wings, obstructed their access. Despite Shweta raising concerns about the shared usage of common areas, the situation escalated when one of the men attempted to push her off the treadmill. Sandip, unhappy with their behavior, confronted the four individuals.

While the accused in the case narrated their version of the entire incident too to Pune Pulse. In their statement, they stated that a false narrative has been maliciously spread against several committee members of Elina Living Phase 2, comprising of C-D & E-F societies.
Elina Living premises are made of three (3) societies:
Elina A-B (Phase 1),
Elina C-D (Phase 2) and Elina E-F (Phase 2). For context, C-D and E-F, though separate societies, are often collectively referred to as CD-EF (jointly part of Phase 2).

The dispute revolves around the usage of common amenities, particularly the gymnasium.

The clarification further mentioned that
Phase 1 A-B’s managing committee, through written communication, expressed their unwillingness to pay security charges, electricity and housekeeping bills for amenities beyond November. Consequently, the builder closed the common amenities, causing significant inconvenience to CD-EF residents who have duly paid for these facilities.

The clubhouse and gym were constructed alongside CD-EF, many years after A-B’s completion. Despite waiting from December 1st to 22nd for A-B to provide necessary security and share costs, CD-EF’s repeated follow-ups were met with refusal. Subsequently, CD-EF took the initiative to deploy security at their own expense to reopen the amenities for their members.
The video presented here illustrates how CD-EF members courteously explained the situation to A-B residents and encouraged them to seek clarification from their A-B committee.

Regrettably, a certain individual from A-B, as seen in the video, along with her husband, has distorted the truth to an alarming extent. With the support of some associates, they have been tormenting and traumatizing innocent CD-EF families. The video, shared openly, allows viewers to form their own judgment on the extent to which some individuals may go for false fame and popularity. It is disheartening to observe media channels participating in such propaganda under the guise of news reporting.

Upon reviewing the video, it becomes evident that, apart from a few instances of dispute, members in the video generally remained cordial. Children played in the background, committee members’ kids were visible, and even the lady’s husband interacted jovially and amicable with committee members. However, the lady appeared uncomfortable with the camaraderie and seemingly provoked her husband into an unnecessary altercation. Following the brief brawl, members are seen trying to diffuse the situation and, after the lady’s husband was hurt, encouraging him to seek medical attention.
False claims, such as the use of weapons and dragging from a treadmill, were made by the lady.

The accused, identified as Rupesh Chavan, Sagar Shejul, Raju Bindra, and Samuel, were apprehended by the Kondhwa police.

A case has been filed under Sections 324, 352, 504, 34, 506 of the Indian Penal Code (IPC).
