File Criminal Case Against Builders Failing To Supply Water To Residents : Demand Moshi Residents

Pune: Construction professionals in Pimpri-Chinchwad city had given their word that they will ‘supply water at their own expense’ to the society owners while submitting the completion certificate for their housing project to the Pimpri Chinchwad Municipal Corporation (PCMC).

However, the written undertaking is being violated by not providing water to society. Hence, Sanjeevan Sangale, President of the Chikhali-Moshi-Pimpri Chinchwad Housing Society Federation, has demanded the filing of criminal offences against such builders under Section 200 of the Indian Penal Code (IPC).

Sangle said, “Most of the builders in the city have violated the written undertaking that they will supply water at their own expense to the housing societies. We have repeatedly informed Shekhar Singh, PCMC commissioner about this. However, all such builders are being supported by the administration. We are being exploited in collusion by the administration and builders.”

As per information, a statement has been given to Shekhar Singh in this regard. It has referred to the meeting held on August 30 2023 in the presence of the office bearer of the Federation and MLA Mahesh Landge in the Commissioner’s Chamber.

Builders in the city of Pimpri-Chinchwad take part completion certificates for their housing projects as well as by writing an undertaking on oath that they will supply water to the developer society holders at their own expense. But, after that, none of the builders supply water to the flat holders at their own cost. On the contrary, they incur these expenses from the upfront maintenance costs taken from the flat owners.

It is an offence under the Indian Penal Code Section 200 if a citizen or a group of companies or a professional violates an undertaking. Also, in order to defraud the flat holder in addition to the guarantee, this builder should clearly mention in their contract that the flat holder will pay the cost of the water purchased from the customer and the fraud on the citizens and the Pimpri Chinchwad Municipal Corporation should be stopped.

The builders who have written an undertaking that they will supply water to the flat holders at their own cost while obtaining the construction completion certificates should be ordered to supply water to the society holders as per the undertaking.
