As per general legal principles, tenants are not responsible for normal wear and tear caused by everyday use. This includes minor wall stains, faded paint, or small plumbing issues that occur naturally over time. Such maintenance is typically the landlord’s responsibility and cannot be charged to the tenant.

When Is the Tenant Liable?

However, the situation changes if damage is caused due to negligence or misuse by the tenant. Structural damage such as broken doors or windows, damaged fittings, or unauthorized alterations to the property can make the tenant liable. In such cases, landlords have the right to recover repair costs from the tenant, often by deducting from the security deposit.

What Does the Law Say?

Although rental laws vary across states, the Model Tenancy Act 2021 provides broad guidelines. It states that tenants must return the property in the same condition as received, excluding normal wear and tear. If disputes arise regarding the condition of the property or deductions, the matter can be resolved legally through appropriate authorities or courts.

How to Avoid Disputes

To prevent conflicts:

  • Clearly define repair and maintenance clauses in the rental agreement
  • Document the property’s condition at the time of possession
  • Maintain records, photographs, and communication
  • Ensure transparency during move-out inspections

Importantly, landlords cannot arbitrarily withhold the entire security deposit, and tenants must also ensure responsible use of the property during their stay.
