According to the Maharashtra government, every rental agreement must be in writing and registered online. The application of this registration is mandatory under the Maharashtra Rent Control Act, 1999. The earlier practice of agreements on stamp paper is no longer considered legally sufficient.

This registration requirement applies to both landlords and tenants. The decision has been taken to make transactions between landlords and tenants more transparent. Online registration will create a proper record of rental agreements, which can help resolve disputes in the future.

Key changes in rental agreement rules

Several important changes have been implemented in the rental laws. Rental agreement online registration is now required for all properties. Contracts made only on stamp paper are not valid anymore.

For residential properties, the deposit can be kept equal to three months’ rent. For commercial properties, the deposit can be equal to six months’ rent. A minimum 11-month rental agreement is required for online registration, and a digital seal is mandatory on the agreement.

The government has specified clear consequences for non-compliance. If landlords and tenants do not register their rental agreement online, the owner can be fined Rs 5,000 or face imprisonment for up to three months. This penalty is designed to ensure everyone follows the new system.
