Pune News : PMC Demolishes Cloth Shop on F C Road, Ignoring Court Stay Order : Alleges Shop Owner

Pune, July 19, 2023 : The Pune Municipal Corporation demolished a shop called ‘Sagar Shirts’ located in Venus Lane, near Roopali Hotel on Fergusson Road in Pune on Wednesday afternoon. However, the shop owners have claimed that they have a stay order from Pune’s District and Sessions Court against the demolition.

Speaking to Pune Pulse, Sagar More, Co-owner of Sagar Shirts shop, in Pune said, “We have this shop of readymade clothing at Venus Lane for 40 years now. We have a proper shop act for it as well. In September 2021, we got a stay order from the District & Sessions Court of Pune on the PMC’s notice of vacating the shop in 10 days. The case is still going on. The next hearing is today. Still, the PMC demolished the shop on July 18. I don’t understand how can the PMC demolish our shop if the court has given a stay order? We asked the PMC if they have a certified court order of revoking the stay order. But the PMC didn’t show us any documentation & simply demolished our shop. Who is going to pay for our loss now? Hence, we demand complete reimbursement of our loss & justice.”

Rupali More, Co-owner of Sagar Shirts shop, Pune said, “In August 2021, the civic body issued us a notice of vacating the shop within 10 days as it was encroaching the space than what was allotted. However, we have all the documents to which we have built that shop in the allotted space. Hence, we challenged this notice in Pune court and in September 2021, the court issued a stay order on this notice. After that, the PMC challenged this stay order and the case is still going on in the court. About 10 to 13 hearings have been held so far. The next hearing is on July 19. However, the PMC came and demolished the shop, disobeying the court order. We don’t understand that, despite having a stay order on the demolition & the case still going on, how did the PMC destroy this shop? Who gave them this power to violate the court order.”

Pune Pulse tried to contact the concerned PMC officials however, could not connect till the filing of this report.
