Pune: October 30, 2025: In a major development, justice has finally prevailed in the Seth Hirachand Nemchand Memorial Trust (H.N.D. Jain Boarding) land sale case in Pune. Maharashtra State Charity Commissioner Amogh Kaloti has, through an order dated October 30, 2025revoked the earlier approval granted on April 4, 2025, for the sale of the trust property. The Commissioner has also cancelled the sale deed and power of attorney and directed that the property be restored to the trust.

According to the order, the transaction made with Gokhale Landmarks LLP, a developer firm, has been completely annulled, and the trust is mandated to refund the sale amount (after deducting TDS). Furthermore, the property must be re-registered under the trust’s ownership.

Background of the Case

The legal battle had been ongoing for the past five months. The H.N.D. Jain Boarding, a historic institution built for students and the Jain community, was allegedly sold to a builder through improper means. The issue was first raised by Akshay Jain, Anand Kankaria, Swapnil Gangwal, and Mahavir Chougule, who collected documentary evidence and presented the case. Under the guidance of Acharya Gurudev Guptinandi Ji Maharaj, the legal efforts were led by Adv. Yogesh Pande, Anna Patil, Chandrakant Patil, and Sukaushal Jinturkar, who played a vital role in managing the case through the hearings.

Key Points from the Order

  1. The sale approval granted to the trust on April 4, 2025, has been cancelled.
  2. The sale deed and power of attorney executed on October 8, 2025, are declared null and void.
  3. The trust must return the sale proceeds (after deducting TDS).
  4. The property must be restored in the name of the trust.
  5. Both applications (CC/08/2025 and CC/50/2025) have been disposed of.

Akshay Jain, General Secretary, Maharashtra Youth Congress, and Member, Jain Hostel Protection Committee, said, “This was not merely a legal battle for one property—it was a fight for students’ rights, the faith of the Jain community, and the principles of justice. The struggle was challenging, but we received immense support from all sections of society—across castes, religions, and political parties. This verdict is not limited to one trust; it sets a precedent for transparency and justice for all charitable institutions under the Charity Act. It is truly a landmark judgment. Our immediate goal now is to reopen the hostel.”

Laxmikant Khabia stated, “The Jain community has always walked the path of non-violence, and today’s victory marks the complete success of that perseverance. We are deeply grateful that Maharashtra Chief Minister Devendra Fadnavis kept his promise to the Jain community 100%. We extend heartfelt thanks to Deputy Chief Minister Ajit Pawar, Chief Minister Eknath Shinde, Union Minister Murlidhar Mohol, former MP Raju Shetti, former MLA Ravindra Dhangekar, Abhay Chhajed, and all who contributed to this success.”

Adv. Yogesh Pande added, “We meticulously examined every legal aspect and fought tirelessly, day and night, to win this battle. It wasn’t easy—we faced proceedings in the High Court and before the Charity Commissioner—but we were determined to see it through, and we succeeded. Our efforts for justice will continue.”
